CHILD CUSTODY RIGHTS FOR FATHERS

Child custody rights for fathers are changing. Many courts are not just giving custody to the mothers but it must be proven that the mother is more suitable. Child custody rights for fathers is changing, especially if the mother smokes.

The Colorado Clean air act went into effect in July of 2006 and this says that children don’t have to be the victims of second hand smoke because second hand smoke kills. It has been proven that second hand smoke is harmful and children don’t have to breath in the air. Child custody rights for fathers when the mother is a smoker is looking bright.

Judges will be and are changing the way that they are awarding child custody rights for fathers when the mother smokes. The Colorado Clean Air Act was designed to protect people from second hand smoke. Women are losing custody of their children if they are smokers. Women will be losing rights to visitation if they are smoking in front of their children, in the same room, or vicinity. Men who are smokers will be given the same consideration. Child custody will not be the only thing considered by a judge but also how visitation is allocated.

Second hand smoke includes smoking in the same room as the children, smoking in the car while you are driving with the children in the backseat, and more. Children have the right to breath clean air and no one has the right to take the clean air that they breath away from them. Second hand smoke is not only depriving the children from clean air but putting the child’s health at risk to lung cancer and other long term effects of breathing in the cigarette smoke.

It is expected that judges will determine the allocation of parenting time and give child custody rights for fathers if the mother is a heavy smoker. If the father is a smoker then the same law will apply.

An advantage for child custody rights for fathers is looking brighter with the Colorado Clean Air Act protecting children from breathing in cigarette smoke. If your child’s mother is a smoker, she is risking the child’s health.
